THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15 of 2015 ORDER:

This writ petition is filed seeking a writ of Mandamus declaring the proposed action of respondents in trying to alienate the petitioner's land to an extent of Ac.03.30 cents in Revenue Survey No.351/3 of Merlapaka Village, Yerpedu Mandal, Chittoor District to the proposed IIT or others without following due process of law as contemplated under the Land Acquisition Act as illegal and arbitrary.

The case of the petitioner is that he is an exserviceman and he was allotted the said land by the then Mandal Revenue Officer, Yerpedu, through proceedings dated 28.06.1992. It is also stated that on 06.08.2010, pattadar pass books and title deeds were issued in his favour in respect of the said land and he is in peaceful possession and enjoyment of the same. His grievance is that the respondents are trying to alienate the petitioner's land without following due process of law.

Heard learned counsel for the petitioner and learned counsel for the respondents.

In view of the above, the respondents are directed not to dispossess the petitioner from the land in question, without following due process of law.

With the above direction, the writ petition is disposed of. There shall be no order as to costs.
