THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26320 of 2017 ORDER:

The petitioner states that he is the owner of the auto rickshaw bearing No.AP23 U 6377. While so on 13.04.2017, his auto was hired for illegally transporting ten bags of mid day meal rice weighing about five quintals from the Primary School by its Head Master. The same was seized and a case in Crime No.34 of 2017 was registered under Sections 409 and 420 of IPC read with Sections 6A and 7 of the Essential Commodities Act, and the petitioner's vehicle was deposited before the second respondent. Hence, the petitioner prays for release of the vehicle.

In the circumstances, this Writ Petition is disposed of giving liberty to the petitioner to submit an application for release of the vehicle before the competent authority, within a period of one week. After receipt of the said application, the competent authority shall consider release of the vehicle, subject to the terms and conditions imposed by it, within a period of one week thereafter. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
