Advocate for 1st respondent filed memo dated 06.09.2016 stating that during pendency of this appeal, respondent No.1 has settled the matter with respondent No.2 to 4, who are in possession of the suit schedule property as purchasers of the share of respondent No.1, as such, E.P.No.157 of 2009 filed in O.S.No.70 of 2000 is not pressed.

Advocate for appellants submitted that in view of memo filed on behalf of respondent No.1, nothing survives in this appeal and appeal can be closed by recording the memo.

Accordingly, the memo is recorded and appeal is closed. 5.
