THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13609 OF 2025 ORDER :

This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, by the petitioner/Accused seeking regular bail in connection with FIR No.122 of 2025 of Markook Police Station, Siddipet District. The offences alleged against the petitioner are under Sections 329(4), 118 (1), 115(2) and 352 of Bharatiya Nyaya Sanhita, 2023.

The case of the prosecution is that on 13.09.2025 the complainant lodged a complainant before police stating that on 11.09.2025 at about 6:00 PM, while he was sitting in front of his house, the petitioner who is residing to opposite to his house, approached him and began abusing him with filthy language. When the complainant questioned the reason, petitioner herein accused him of killing his elder brother eight years ago. The complainant denied the allegation and went inside his house, but petitioner unlawfully entered into his house, assaulted him, striking the left side of his forehead with his fist. The complainant's mother, Kondi Yellamma, intervened

- 2 - and when questioned him, the petitioner hit her in the chest with a mobile phone, causing her to lose consciousness and collapse. She was admitted to NIMS Hospital for treatment. The delay in filing the complaint was due to the complainant attending to his mother's medical needs. Hence, requested the police to take necessary action against the accused basing on which the police registered the case against the accused for the above offences.

Heard Sri Khaja Vizarat Ali, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that there is no intention for the petitioner to cause injury to the deceased and even according to the prosecution when there is a quarrel between petitioner and the son of deceased, she came in middle, as such sustained injury and died due to old age who is about 75 years old. Further material part of investigation is already completed and petitioner is in jail from 20.09.2025. Hence, prayed this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the alleged offence against the petitioner is severe in nature the deceased died in the hands of petitioner. As such, petitioner is not entitled for bail and prayed to dismiss this petition.

Considering the submissions made by both the counsel and the material on record the petitioner is in jail from 20.09.2025 and Lws.1 to 19 are examined including the investigating officer. Considering the period of incarceration of petitioner in jail and the investigation this Court deems it fit to grant bail to the petitioner subject to the following conditions : i.

The petitioner/Accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of Additional Judicial First Class Magistrate, Gajwel.

ii.

The petitioner/Accused shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight

(8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/Accused shall abide by the other conditions stipulated in Section 483(2) of BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
