HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7577 of 2017 ORDER:

Heard learned counsel for the petitioner, who is owner of a wine shop and arrayed as A2 in Crime No.23 of 2017 on the file of the Duttalur Police Station, S.P.S.R.Nellore District, registered for the offence punishable under Section 34(A) of the A.P.Excise Act and learned Public Prosecutor representing the State. Perused the grounds urged in the quash petition, mediator report, F.I.R. and other material on record.

A perusal of the material on record shows there is nothing to interdict the investigation.

Having regard to the above, the Criminal Petition is disposed of, directing the police not to arrest the petitioner/ A2 pending investigation and they can secure the accused for the purpose of investigation, as and when required.
