HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.20829 of 2014 ORDER:
Heard the learned counsel for the petitioner as well as the learned Government Pleader for the respondents. The prayer sought in the writ petition is as under: "... to issue an appropriate writ or order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondent No.4 in not registering the complaint dated 04.03.2014 as per proceedings C.No.197/CCC:OR/2014 dated 04.03.2014 forwarded to respondent No.4 and respondent No.3 dated 28.06.2014 also forwarded to the respondent No.4 in respect of the forged signatures and tampering of the records created fraudulent documents produced by the culprits in the name of the petitioner in respect of land in Sy.No.510 for admeasuring Ac.1.05 gts and Sy.No.499C admeasuring Ac.2-15 gts, 511/A admeasuring Ac.2039 gts total admeasuring Ac.
6-19 gts situated at Raghunathpally Revenue Village, Zafargadh Mandal, Warangal District as illegal, arbitrary and consequently to direct the respondent No.2 and 3 against respondent No.4 to take appropriate action for negligence of duty in not registering the complaint of the petitioner dated 04.03.2014." During the course of hearing, learned Government Pleader placed on record written instructions dated 08.08.2014 issued by the Sub-Inspector of Police, Jaffergadh Police Station, Warangal Urban District.
From a perusal of the said written instructions, it is revealed that the 4th respondent received the petitioner's complaint through proper channel for enquiry and necessary action. During the course of enquiry, it was revealed that there was a civil dispute between the petitioner, her parents and her brother with regard to land in Sy.Nos.510, 499C and 511/A admeasuring Acs.6-19 guntas situated at Raghunathpally Revenue Village, Jafergadh Mandal of
Warangal District. Since the matter is civil in nature, the 4th respondent advised the petitioner to approach the appropriate Court of law for redressal.
In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be closed.
Accordingly, the writ petition is closed. No order as to costs.
