ORDER

This petition is filed under Section 482 Cr.P.C. to quash the proceedings in P.R.C.No.12 of 2017, pending on the file of Additional Judicial Magistrate of First Class, Vizianagaram, on various grounds. The petitioners allegedly committed the offence punishable under Sections 498-A and 307 IPC and Sections 3 and 4 of the Dowry Prohibition Act.

Since the offence punishable under Section 307 IPC is exclusively triable by the Sessions Court, the matter was registered as PRC. The petitioners were already enlarged on bail by the Sessions Court in Crl.M.P.No.146 of 2017 on 22.05.2017. In view of Rule 30 of the Criminal Rules of Practice, the petitioners are not required to appear before the Court till summons are received by him from the Sessions Division. Therefore, the appearance of the petitioner before the Magistrate in PRC.No.12 of 2017 is hereby dispensed with, With the above direction, without touching the merits of the case, the criminal petition is disposed of.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
