HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.30080 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 3rd respondent-Joint Sub Registrar-I, in orally refusing to receive the documents presented by the petitioners for registration in respect of land admeasuring Ac.1.15 gts, situated at Sy.Nos.70/1/1, 70/2/3 of Dilavarguda, Sultanpur Village, Ameenpur Mandal, Sangareddy District, as illegal and arbitrary. The grievance of the petitioners is that they are the lawful owners and possessors of land admeasuring Ac.1.15 gts, situated at Sy.Nos.70/1/1, 70/2/3 of Dilavarguda, Sultanpur Village, Ameenpur Mandal, Sangareddy District, having jointly purchased the same through a registered sale deed dated 11.12.2015, and since then, the petitioners have been in continuous peaceful possession and enjoyment of the same, without there being any interruption.

It is further stated that the names of the petitioners were also recorded in the revenue records vide proceedings dated 7.9.2016 of the Tahsildar, Patancheru Mandal. While things stood thus, due to personal necessities, now the petitioners want to sell the subject land and thereby approached the 3rd respondent and presented the documents on 17.8.2018 for registration, who in turn refused to receive the same without assigning any reasons. Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 3rd respondent-Sub Registrar-I, to receive the documents for registration, if they are in accordance with the law.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
