THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.21895 of 2015 ORDER:

The petitioner was appointed as a permanent fair price shop dealer of shop No.270, Patamata, Vijayawada, Krishna District. On the basis of the information received from the National Informatics Centre, Hyderabad, a show cause notice was issued to the petitioner on 27.06.2015. The petitioner submitted her explanation on 29.06.2015. In the meanwhile, a report was also received from the Assistant Supply Officer, Circle-II, Vijayawada, on 29.06.2015 and also from the Special Deputy Tahsildars (PDS), Kanchikacherla, Nandigama, Vuyyuru, Mylavaram and Gannavaram, on 30.06.2015. Based on the same, an order was passed by the second respondent on 01.07.2015 cancelling the authorisation of the petitioner, besides imposing a penalty of Rs.4,76,447/-. Challenging the same, the present Writ Petition is filed.

A perusal of the show cause notice dated 27.06.2015 indicates that there was huge variations in the stock of rice and kerosene oil and along with the same, in respect of three other commodities also there was variation. The petitioner submitted explanation stating that due to insufficient knowledge in the e-pos machines, the mistakes had occurred. Besides that, the petitioner did not submit any explanation. However, from the records and from the inspection conducted by the Special Deputy Tahsildar, the irregularities against the petitioner are found to be correct. A detailed order was passed on 01.07.2015 and in view of the same, this Court is not inclined to interfere with the said order at this stage.

However, liberty is given to the petitioner to file an appeal before the competent authority, who shall deal with the same in accordance with law.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as

to costs.
