HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 15395 of 2009 Order:

This Writ Petition was filed challenging the action of the respondents in taking away the petitioner's land admeasuring 1307.8 sq. yards situated in Survey No.104/10 of Kanuru village, Patamata, Krishna District.

This Court, while ordering notice before admission on 30.07.2009, directed the respondents not to interfere with the said land in any manner whatsoever. The said order has been in operation till today and no counter affidavit is filed.

The petitioner claims to have purchased the said land under three registered sale deeds dated 13.12.2000, 22.12.2000 and 12.01.2001 respectively. The vendors of the petitioner purchased the same under a registered sale deed dated 22.06.1970. The respondents wanted to acquire a portion of the said land in order to widen the 40 feet road to 100 feet road. When no proceedings were issued under Land Acquisition Act, the Writ Petition was filed.

In view of the claim of the petitioner that the land is a private land it is needless to observe that the respondents shall not interfere with the said land except in accordance with law.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
