THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14073 of 2024 ORDER:

This Criminal Petition is filed under Section 483 read with 484 (2) of Bharatiya Nagarik Suraksha Sanhita, 2023 to reduce the surety amount by modifying the bail order dated 11.09.2024 passed in Crl.M.P.No.4088 of 2024 in SCPCS No.204 of 20244 by the learned XII Additional Sessions Judge cum Special Court for the Trial of Protection of Children from Sexual Offences Act cases, Hyderabad.

Heard Sri Mohd Musaferullah Khan, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent.

Learned counsel for the petitioners submitted that the trial Court while allowing the Crl.M.P.No.4088 of 2024 directed the petitioner to comply the conditions passed therein. Learned counsel further submitted that as per the conditions the petitioner shall be enlarged on bail on their execution of personal bond for a sum of Rs.25,000/- with one local surety

for likesum each to the satisfaction of the XII Additional Sessions Judge - Cum - POCSO, Hyderabad and other conditions. He further submitted that the petitioner is in jail from 25.06.2024 and modify the condition to reduce the surety amount with one surety and prayed the Court to modify the said conditions.

Having regard to the submissions made by the learned counsel for the petitioner, this Court is inclined to modify the order dated 11.09.2024 passed in Crl.M.P.No.4088 of 2024 by the learned XII Additional Sessions Judge - Cum - Special Court for the Trial of Protection of Children from Sexual Offences Act cases, Hyderabad only to the extent of the petitioners executing a personal bond with surety and the petitioner is directed to execute a personal bond of Rs.5,000/- with one surety to the satisfaction of the concerned Court. 5.

With the above modification, this Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall also stand closed.
