THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14120 of 2024 ORDER:

This Criminal Petition is filed under Section 483 read with 484 (2) of Bharatiya Nagarik Suraksha Sanhita, 2023 to reduce the surety amount by modifying the bail order dated 19.06.2024 passed in Crl.M.P.No.2575 of 2024 in Crime No.515 of 2023 by the learned XII Additional Metropolitan Sessions Judge, Hyderabad. 2.

Heard Sri Mohd Musaferullah Khan, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent. 3.

Learned counsel for the petitioners submitted that the trial Court while allowing the Crl.M.P.No.2575 of 2024 directed the petitioner to comply the conditions passed therein. Learned counsel further submitted that as per the conditions the petitioner shall be enlarged on bail on their execution of personal bond for a sum of Rs.5,000/-

with two sureties for likesum each to the satisfaction of the XII Additional Metropolitan Sessions Judge, Hyderabad and on condition that the petitioner has to appear before the SHO of PS Humanyun Nagar on every Sunday in between 10.00 - 11.00 AM for a period of three months or till filing of the charge sheet whichever is earlier. He further submitted that the petitioner is in jail from 12.03.2024 and modify the condition to reduce the surety amount with one surety and prayed the Court to modify the said conditions.

Having regard to the submissions made by the learned counsel for the petitioner, this Court is inclined to modify the order dated 19.06.2024 in Crl.M.P.No.2575 of 2024 passed by the learned XII Additional Metropolitan Sessions Judge, Hyderabad only to the extent of the petitioners executing a personal bond with surety and the petitioner is directed to execute a personal bond of Rs.5,000/- with one surety to the satisfaction of the concerned Court.

With the above modification, this Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall also stand closed.
