THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.21156 OF 2017 ORDER:
This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a writ of mandamus, or any other appropriate writ, order or direction declaring the action of the respondents in interfering with peaceful possession and enjoyment of the petitoenr over the property to an extent of Ac.3.79 cents & Ac.4.51 cents in Sy.No.209, M.Nagulapalli Village, Dwaraka Tirumala Mandal, West Godavari District, Andhra Pradesh, without following process of law and without issuing Notice as illegal, arbitrary, without jurisdiction and in violation of the principles of natural justice and pass such other order or orders as may deem fit and proper in the circumstances of the case." 2.
Heard learned counsel for the petitioner and perused the prayer in the writ petition with supporting affidavit and also heard the learned Government Pleader for Land Acquisition, though not impleaded as a party, in saying on behalf of 1st respondent and for 2nd respondent, there is a standing counsel, who offered to file vakalat from the instructions.

Undisputedly, the petitioner's vendor, whose name in the revenue records, is served with notice and petitioner got
knowledge through his vendor about the laying of the pipeline in the land covered by survey No.209 of an extent of 0.34 cents of M.Nagulapalli Village, Dwaraka Tirumala Mandal, West Godavari District, Andhra Pradesh.

Though the writ petition contains several prayers, impugning the proceedings saying no notice, from what the petitioner submitted that he got knowledge of the notice from his vendor, as notice was sent to him and he claims that he got right over the subject property through his vendor and the revenue record also shows the name of his vendor and the petitioner is interested only in getting the compensation. 5.
Thus, this writ petition is disposed of, directing the petitioner to submit a written representation by enclosing a copy of the registered sale deed, within one week from date of receipt of the order and the respondents shall consider and pass appropriate orders as expeditiously as possible for entitlement of compensation by the petitioner, instead of his vendor, since he purchased under the registered sale deed. Further grievance of the petitioner, if any, is left open. 5.
Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
