HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 30158 of 2018 ORDER:

The present writ petition came to be filed seeking issuance of writ of mandamus to direct the respondents 2 and 3 for not considering the petitioner's representations dated 27.04.2018 and 08.05.2018 and issuing pattadar pass books to the respondent Nos. 4 to 9, without any prior notice to the petitioner, as illegal, improper and unconstitutional. 2.

The learned counsel for the petitioner would submit that grave injustice would be caused to the petitioner if the pattadar pass books are issued in favour of the unofficial respondents, as the petitioners are joint owners of the schedule properties.

A perusal of the legal notice dated 27.04.2018 would show that already mutations have been carried out in the revenue records. That being the position, the only remedy available to the petitioner is to question the said mutations before the concerned authorities, in accordance with the provisions of the A.P. Record of Rights in Land and Pattadar Pass Books Act.

Having regard to the facts and circumstances of the case, the writ petition is disposed of at the admission stage, with consent, giving liberty to the petitioner to avail the remedy available to him under law. 5.
