THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10088 of 2015 ORDER:

This Criminal Petition is filed by the petitioner - A2, under Section 438 of the Code of Criminal Procedure, seeking to grant bail in Crime No.229 of 2014 on the file of Pedavegi Police Station, West Godavari District, registered for the offences punishable under Sections 408, 468, 471 and 379 IPC. Heard and perused the material available on record. The allegation against the petitioner is that he purchased the fertilizers, which were transported by A1, who is a worker under the de facto complainant. Learned counsel for the petitioner submitted that the petitioner never received any stock from A1 and he was falsely implicated in the present case and that the petitioner is ready and willing to cooperate with the investigation. Admittedly, the crime was registered in the year 2014. Till now, the respondent police have not taken any steps to arrest the petitioner. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner.

In the circumstances, the petitioner - A2 is directed to surrender before the Magistrate concerned on or before 21.10.2015 and on such surrender, he shall be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the like sum to the satisfaction of the said Magistrate. Further, the petitioner is directed to appear before the Station House Officer concerned, daily between 10 a.m. and 5 p.m., for a period of (10) days.
