THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.7623 of 2016 ORDER:

It is brought to the notice of this Court that in identical set of circumstances this Court disposed of writ petition No.33164 of 2015 and a copy of the same is also placed on record by the learned counsel for the petitioner as material paper. In view of the above order, there shall be similar following order in this case also:

Heard Sri N.M. Krishnaiah, learned counsel appearing for the petitioners and Sri A.Rama Rao, learned Standing Counsel for the respondents-APSRTC.

According to the petitioners, they were appointed as Conductors initially on daily wage basis by a duly constituted selection committee.

Thereafter they were appointed as Conductors in the respondent-organization as per the proceedings dated 13-03-2000 of the 2nd respondent. The services of some of the Casual Conductors, who were appointed as Casual Conductors and who have completed 240 days service as Conductors along with the petitioners, were regularized through proceedings dated 14-03-2001 issued by the 1st respondent with effect from 31-12-2000. It is submitted by the petitioners that the services of some of the juniors to the petitioners who joined as Casual Conductors were also regularized in the year 2001, but unfortunately the services of the petitioners were regularized with effect from 05-10-2007.

Therefore, the petitioners along with others submitted a representation dated 01-01-2008 to the respondents requesting them to consider their date of regularization of service as Casual Conductors on par with others with effect from the date on which their juniors were regularized and to pay the difference of pay and attendant benefits calculating the service from 31-12-2000 instead of 05-10-2007 but no action was taken. The petitioners submitted another representation dated 18-09-2015 to respondents 1 and 2 reiterating the same request. The aforesaid representation was not considered and no orders have been passed on the said representation. The petitioners, therefore, filed the present writ petition to direct the respondents to consider the representation submitted by him and pass appropriate orders thereon.

In view of the above reason, the writ petition is disposed of at the stage of admission, directing respondents 1 and 2 to consider the representation dated 18-09-2015 submitted by the petitioners regarding their date of regularization and payment of arrears and granting other attendant benefits and pass appropriate orders thereon within a period of 8 (eight) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
