O R D E R

This contempt case is filed alleging violation of the orders passed by this Court on 04.02.2014 in W.P.M.P.No.3631/2014 in W.P.No.2976/2014.

When the matter is listed on 26.12.2014, the petitioner's counsel sought time. Again when the matter is listed on 05.06.2015, there is no representation on behalf of the petitioner and this Court directed to list the matter under the caption 'for dismissal'. Even today when the matter is listed under the caption 'for dismissal', request is made on behalf of the petitioner for adjournment. In this case, this Court passed orders on 04.02.2015 in W.P.M.P.No.3631/2014 in W.P.No.2976/2014 directing the respondents to ensure compliance with the provisions of G.O.Ms.No.7 Animal Husbandry, Dairy Development and Fisheries (Fish-II) Department, dated 16.03.2013.

While so, the 2nd respondent filed counter stating that the District Committee has rejected the application filed by the respondents 8 and 9 for aqua culture and informed to stop cultivation in the tanks. Against the same, the respondents 8 and 9 again approached this Court by filing W.P.No.16842/2014 and this Court granted interim order dated 08.07.2014 directing the respondents not to interfere with the peaceful possession and enjoyment of fish and aqua tanks of respondents 8 and 9 and finally by order dated 21.10.2014 in W.P.No.16842 of 2014 disposed of the writ petition with a direction to the District Collector to reconsider the petitioners application after supplying all the relevant material on which he is seeking to place reliance and pass a speaking order afresh within two months from the date of receipt of copy of this order. In view of the said order, the respondent officials could not comply the orders of this Court passed on 04.02.2014 in

W.P.M.P.No.3631/2014 in W.P.No.2976/2014.

In view of the subsequent filing of the writ petition by the unofficial respondents 8 and 9, I do not see any violation of the orders passed by this Court by the respondents.

Accordingly, the contempt case is dismissed. No costs. As a sequel, miscellaneous petitions pending if any, shall stand closed. ___________________________ A.RAJASHEKER REDDY,J Date: 06.07.2015 dv
