Chittiboina Yesobu, v. The State Of Andhra Pradesh,
HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.10796 of 2017 ORDER:
Heard learned counsel for the petitioner as well as the learned Government Pleader for Panchayat Raj appearing for respondent Nos.1 to 3, and the learned Standing Counsel for 4th respondent - Gram Panchayat.
2.
The petitioner herein entered into the shop belonging to the 4th respondent - Gram Panchayat by way of a lease more than 12 years back. Even according to the petitioner, the said period of lease, which was subsequently renewed, also is coming to an end by 31.03.2017. He made representations for extension of the lease. The grievance of the petitioner is nonconsideration of the representations made by him for extension of the lease period.
3.
Admittedly, the present lease of the petitioner is coming to an end by 31.03.2017. It is also submitted by the learned Standing Counsel for 4th respondent - Gram Panchayat that the Gram Panchayat conducted auction on 23.03.2017 wherein the subject shop fetched Rs.85,000/- i.e., an excess of Rs.58,221/- than the earlier lease amount. Since the petitioner has no subsisting right to continue in the subject shop, this Court does not find any valid reason to scuttle the
AVSS,J W.P.No.10796 of 2017 4th respondent - Gram Panchayat from proceeding with the auction conducted on 23.03.2017.
4.
Accordingly, this writ petition is dismissed. 5.
As a sequel, Miscellaneous Petitions pending consideration, if any, in the Writ Petition shall stand closed. No order as to costs.
