ORAL ORDER:

Petitioner claims to be operating a chicken centre in Vikarabad. He was served with notice dated 30.7.2015 alleging that residents have complained against the petitioner for not maintaining hygienic conditions and causing lot of health hazards to the neighbors. Accordingly, petitioner filed a reply on 31.7.2015, however, so far no orders are passed.

2. Learned counsel for petitioner submits that while serving notice shop of the

petitioner was also directed to be closed and petitioner is unable to carry out his business all along and for no fault on his part, since no orders are passed, grave prejudice is caused to the petitioner. He further submitted that due to festival season, if petitioner is not permitted to carry on his business, he will suffer irreparable loss.

3. Heard learned counsel for petitioner and learned standing counsel for second respondent.

4. Having regard to the fact that since explanation is already filed by the petitioner on 31.7.2015, without going into the merits of the matter, the respondent municipality is directed to consider the same and pass appropriate orders as warranted by law on or before 20.10.2015.

Subject to above direction, writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. __________________ P.NAVEEN RAO,J Date: 14.10.2015.
