THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.40941 OF 2015 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
The petitioner alleges that her land admeasuring Acs.5.31 cents in Survey No.18 of Sirugapuram Village, Halaharvi Mandal, Kurnool District, is erroneously included in the prohibited list and on account of which, the Sub-Registrar, Alur, Kunrool District, the 4th respondent, is declining to register the document proposed to be executed by the petitioner. Therefore, the petitioner made a representation, dated 14.09.2015, before the Tahsildar, Halaharvi Mandal, Kurnool District, the 5th respondent, complaining wrongful inclusion of her patta land in the prohibited list and vide proceedings in Rc.No.95/2015, dated 16.09.2015, the 5th respondent appears to have found that the petitioner's grievance is justified and the lands are rythwari patta lands and informed the same to the 4th respondent. The petitioner filed the present Writ Petition aggrieved by the action of respondents 1 and 2 in not deleting the said land from the prohibited list.
It is, however, found that the 5th respondent has no power either to add or delete any land from the prohibited list and it is for respondents 1 and 2 to act accordingly and no application appears to have made by the petitioner before respondents 1 and 2. Hence, the Writ Petition is disposed of giving liberty to the petitioner to make appropriate application before the 2nd respondent and if any such application is filed by the petitioner, the
2nd respondent shall examine the same and pass appropriate orders in accordance with law expeditiously, preferably within a period of three weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
