THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE No.460 of 2017 ORDER:

This contempt case was instituted alleging wilful disobedience to the order dated 09.03.2016 passed by this Court in W.P.No.4661 of 2016. By the said order, the Commissioner, Paloncha Municipality, was directed to consider the petitioner's representation dated 06.01.2016 and take appropriate action in the matter, if warranted, in accordance with law after giving an opportunity of hearing to all the parties who would be affected by any decision taken upon the said representation. Sri N.Praveen Kumar, learned counsel appearing for the respondents, would state that pursuant to the aforestated order passed by this Court, an opportunity of hearing was given to all the parties and action was initiated in relation to the unauthorized construction of a tin shed made by the fourth respondent in the writ petition by issuing a notice under Section 228 of the Telangana Municipalities Act, 1965. The details of the action taken were also intimated to the petitioner under the intimation proceedings dated 13.04.2017.

In the light of the aforestated developments, no cause is made out for exercise of contempt jurisdiction as the respondent authority has acted upon the petitioner's representation as directed by this Court.
