ORDER:
This Second Appeal arises out of judgment and decree, dated 28.02.2015, in AS.No.32 of 2014 on the file of the XI Additional District and Sessions Judge, Tenali, whereby he has set aside the judgment and decree, dated 03.04.2014, in O.S.No.24 of 2012 on the file of the Additional Senior Civil Judge, Tenali dismissing the suit.
Sri R.K.Suri, learned counsel for the appellant, requested for permission of the Court to withdraw the Second Appeal with liberty to his client to amend the prayer in Second Appeal No.264 of 2015 for inclusion of the claim for damages.
The Second Appeal is, accordingly, dismissed as withdrawn with liberty to the appellant in terms of the prayer made. As a sequel to dismissal of the Second Appeal, SAMP.No.732 of 2015 filed by the appellant for interim relief is dismissed as infructuous.
