THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.35045 of 2015 ORDER:

The grievance of the petitioner - concern was that the 2nd and 3rd respondents were interfering with its business in Black Jaggery and Jaggery and were not allowing it to carry on its business despite being duly licenced to do so. The Prohibition and Excise Inspector, Station House Office, Dhoolpet, Hyderabad, furnished written instructions dated 06.11.2015 to the office of the learned Government Pleader for Excise stating that no criminal cases had been registered against the petitioner - concern or its proprietor and there was no interference by his office with the business of the petitioner - concern except asking for relevant information in accordance with the Gur (Regulation of Use) Order, 1968, as to the transactions of the petitioner - concern, involving Black Jaggery and Jaggery, in the prescribed proforma periodically.

The aforestated stand of the excise authorities is taken on record. It is not disputed that the petitioner - concern would be required to comply with the norms prescribed under the Order aforestated and furnish data relating to its transactions in the commodities in question in the prescribed proforma periodically. Such requirement cannot be termed to be an interference in the petitioner - concern's business activities. Subject to compliance with the said requirement, the excise authorities do not state that there is any harassment of the petitioner - concern. In that view of the matter, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
