THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.13735 of 2025 ORDER:
The present Criminal Petition is filed praying this Court to enlarge the petitioner on bail, who is arrayed as accused No.1 in Crime No.401 of 2025 before the Shankarpally Police Station, and on the file of the Judicial Metropolitan Magistrate, at Chevella, Ranga Reddy District, registered for the offences punishable under Sections 310(2), 324(3) read with 3(5) of BNS.

The brief facts of case are that on September 12, 2025, around 1:30 PM, near Hussainpur village (Shankarpally, Ranga Reddy), A1-A7 allegedly intercepted the complainant's Ford Figo (TS09 UD 0093) carrying Rs.40 lakh for registration, using a Swift Dzire (TS11 EL 8817). They smashed the rear glass, assaulted occupants, used chilli powder, and snatched the cash. LW-1 was injured and when villagers chased, the Swift overturned near Kothapally, leaving some cash. On receipt of the complaint from complainant, a case was registered against the accused for the offences as alleged.

Heard Sri N.Srushman Reddy, learned counsel for petitioner, and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for respondent - State.

Learned counsel for petitioner submitted that the petitioner who is arrayed as accused No.1 is a cab driver and is innocent and falsely implicated with no evidence beyond inadmissible police confessions. While advocating that petitioner is a law-abiding citizen from a respectable family, no criminal history, with dependents, he prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.
On other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for petitioner stating that the nature of offence being serious, the investigation is still under progress, and that apart, the accused No.5 in this case is still absconding. Therefore, prayed the Court to dismiss the criminal petition. 6.
Having regard to rival submissions made and on going through the material placed on record, it is noted that the petitioner is in judicial custody since 13.09.2025 and it is seen that he is merely a cab driver. Considering the period of
incarceration of petitioner, this Court deems it fit to grant bail to the petitioner, subject to following the below conditions: i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each, to the satisfaction of the Judicial Metropolitan Magistrate, at Chevella, Ranga Reddy District.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by conditions stipulated in Section 480(3) of the BNSS, earlier known as Section 437(3) of Cr.P.C.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
