This writ petition is filed aggrieved by the action of the 2nd respondent in not disposing the appeal filed by the petitioner along with condone delay petition against the orders of eviction passed by the 3rd respondent dated 13-02-2006 in LTRP.No.486 of 2004.

Heard both sides.

Learned counsel for the petitioner submits that the order is passed by the 3rd respondent in the year 2006, but the petitioner came to know about the same only when respondents 4 and 5 are trying to evict him from the subject land. The brother of father of the petitioner, who was pursuing the proceedings, had passed away and the property devolved upon the petitioner and his name was also recorded in revenue records.

On the other hand, learned Assistant Government Pleader for Social Welfare appearing for respondents submits that since the appeal is filed with abnormal delay, no relief can be granted. It is for the 2nd respondent to consider whether delay in filing the appeal is to be condoned or not. In view of the same, the 2nd respondent is directed to dispose of the condone delay petition in accordance with law and also appeal depending on orders in the condone delay petition. Till the disposal of the same, there shall be status-quo

obtaining as on today regarding possession in respect of subject land.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 29-08-2018 Nvl
