THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.33073 of 2012 ORDER:

The present Writ Petition came to be filed seeking to declare the action of the second respondent in initiating and continuing the proceedings dated 27.08.2012 vide No.B/1307/2005, as illegal and arbitrary and consequently direct the respondents to drop the proceedings dated 27.08.2012. A perusal of the impugned notice would show that the petitioner was directed to appear before the Tahsildar, Malkajgiri Mandal, on 30.08.2012, either in person or through their counsel with all the relevant documentary evidence, as per the directions of this Court in W.P.No.20519 of 2010, dated 17.07.2012 and the orders of LGC in No.32 of 2005, dated 29.02.2008. Challenging the said notice, the present Writ Petition came to be filed.

It is to be noted that the Writ Petition is filed challenging the impugned notice, wherein the petitioner was asked to appear before the authority on a particular date. Therefore, at this point of time, no cause for adjudication survives in the Writ Petition. Be that as it may, the petitioner never appeared before this Court. Viewed from any angle, no indulgence is required by this Court in this Writ Petition and the same is liable to be dismissed. Accordingly, the Writ Petition is dismissed. No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
