THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.12499 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused No.4 seeking bail in the event of his arrest in connection with Crime No.678 of 2023 on the file of Bachupally Police Station, Cyberabad, registered for the offence under Section 306 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The complaint was lodged on 07.10.2023 by the son of the deceased stating that this petitioner and three others were responsible for suicide of his father. The reason is that this petitioner and others have taken money from his father and were not retuning the same.

Learned Additional Public Prosecutor has produced a letter written by the deceased which states that four persons including this petitioner have taken money and not retuning the same for the past three years.

Apart from the said allegation of not returning the money, prima facie, there is nothing in the letter to suggest abetment.

In the said circumstances, the relief of anticipatory bail can be considered, subject to following conditions:-

1) The petitioner/Accused No.4 is directed to surrender before the Station House Officer, Bachupally Police Station, Cyberabad, on or before 29.12.2023. Upon such surrender, the said Station House Officer shall release the petitioner/Accused No.4 on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum each to his satisfaction.

2) On such release, the petitioner/Accused No.4 shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of four weeks and thereafter as and when required, for the purpose of investigation.

3) The petitioner/Accused No.4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
