THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13652 of 2025 ORDER:

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of prearrest bail to the petitioners, who are arrayed as accused Nos.6 and 7 in Crime No.554 of 2024 on the file of the Khammam II Town Police Station, Khammam District, registered for the offences punishable under Section 318(4) of BNS.

The brief facts of the case are that, on 16.11.2024, the defacto complainant lodged a report before the police stating that the defacto complainant had invested money to purchase plots. In the meantime, one Madhu and his wife introduced two persons, namely Sai and Srivarshini, who persuaded the defacto complainant to invest the said amount. Thereafter, the complainant came to know that the documents in question were forged and that he had been cheated by the accused. According to the defacto complainant, the role of the present petitioners is that they collected an amount of Rs.3 crores from the defacto complainant and other victims on the pretext of registering property in their names. However, they failed to register the said property and thereby cheated the defacto complainant and others. Hence, the complainant requested the police to take necessary action. Based on the said complaint, the police registered a case for the aforesaid offences.

Heard Sri Nancharla Murali, learned counsel appearing on behalf of the petitioners as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petitioners are innocent of the alleged offences and have no connection whatsoever with the same. The petitioners had already lodged a report against the defacto complainant under Crime No.272 of 2023. A case was registered and a charge sheet was filed. He further submitted that the petitioners were earlier wrongfully implicated in Crime No.185 of 2023. Therefore, the petitioners have no connection with the alleged offence. Therefore, prayed the Court to grant pre-arrest bail to the petitioners by allowing this Criminal Petition.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners, stating that a huge amount is involved in this case and that custodial interrogation of the petitioners is necessary for further investigation. As such, the learned Additional Public Prosecutor prayed the Court to dismiss the criminal petition. 6.

Having regard to the submissions made by both learned counsel and upon perusal of the material available on record, it appears that the petitioners were earlier implicated in the said transactions and a

case was registered against them, for which a charge sheet has also been filed. However, there is no material on record establishing their involvement in the alleged offences. Considering the facts and circumstances of the case, this Court deems it just and proper to grant pre-arrest bail to the petitioner/accused, subject to the following conditions:

The petitioners/Accused Nos.6 and 7 shall surrender before the Station House Officer, Khammam II Town Police Station, Khammam District, within two weeks from today and on such surrender, the said Station House Officer shall release them on bail, on petitioners executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.

ii.

The petitioners/Accused Nos.6 and 7 shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case. iii.

The petitioners/Accused Nos.6 and 7 shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.
