HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 16492 OF 2012 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both parties, the present Writ Petition is disposed of at the admission stage itself.
The present Writ Petition came to be filed to declare the action of respondent Nos.1 and 2 in not taking any action on representations dated 29.12.2011 and 29.03.2012 made by the petitioners seeking action against respondent Nos.3 and 4, who were extracting the water unauthorizedly by digging the Allipoor Cheruvu land belong to Government in Survey No.100 of Allipoor Village, Dandepalli Mandal, Adilabad District as illegal and arbitrary.
Though various grounds are raised in the Writ Petition, learned counsel for the petitioners restricts his prayer seeking a direction to the authorities to pass appropriate orders on the representation dated 29.03.2012 made by petitioners to the Collector.
No counter is filed on behalf of the respondents. On 06.06.2012, this Court while issuing notice before admission directed the District Collector, Adilabad District, to consider the representation dated 29.03.2012 and take appropriate action after putting on notice to the affected parties including respondent Nos.3 and 4. In view of the above, learned counsel for the petitioners submits that inspite of there being an interim order, the District Collector has not taken any action on the representation dated 29.03.2012.
Having regard to the circumstances stated above, the Writ Petition is disposed of directing the District Collector, Adilabad District to take appropriate action pursuant to the representation dated 29.03.2012 after putting on notice to the affected parties and respondent Nos.3 and 4, as early as possible, preferably within a period of six
(06) weeks from the date of receipt of a copy of this order. No costs. Consequently, the Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
