THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No.30169 of 2018 ORDER:

1) The present Writ Petition came to be filed seeking issuance of writ of Mandamus declaring the action of the respondents in threatening to demolish the house of the petitioner and to dispossess her without issuing any notice, as illegal, arbitrary and violative of principles of natural justice.

2) The averments in the affidavit filed in support of the writ petition would show that the petitioner, who was eking out her livelihood by doing coolie works, was sanctioned patta vide Proceedings Rc.NO.35/ 2016/ NTR URBAN-BLC, dated 27.11.2017. Pursuant thereto, the petitioner got demolished the old hut and raised a brick house in an extent of 50 square yards of land and has been living therein along with her three children. While so, on 20.08.2018, the 4th respondent and his staff came to the site and demanded the petitioner to vacate the premises alleging that the 3rd respondent issued a list of houses in her locality, to be demolished and her house is one among those enlisted houses. 3) Learned counsel for the petitioner would submit that the action of the respondents in trying to demolish the house of the petitioner is without following due process law, is illegal and improper.

4) Learned Government Pleader (AP), on instructions, would submit that any action taken shall be in accordance with law. 5) Recording the submissions made, the Writ Petition is disposed of, directing the respondents to follow the due process of law while taking steps for evicting or dispossessing the petitioner from the land in question.
