The present Criminal Petition is filed by the petitioneraccused No.5, seeking the Court to set aside the docket order dated 07.10.2025 passed in Crl.MP.CFR.No.633 of 2025 by the learned Principal District and Sessions Judge, at Medak by extending the time as fixed by the Court for compliance of the conditions imposed on petitioner/accused No.5 by the trial Court in Crl.MP.No.258 of 2025 in Crime No.316 of 2024. 2.

Heard Sri N. Amarnath, learned counsel for petitioner. 3.

Learned counsel for the petitioner submitted that the trial Court had granted Anticipatory Bail to the petitioner by an order dated 25.09.2025 in Crl.MP.No.258 of 2025, directing the petitioner to comply with the conditions stipulated therein, surrender before the trial Court within one week from the date of the order, and furnish the required sureties. He further submitted that, following the issuance of the order, there were continuous public holidays, which

prevented the petitioner from complying with the said conditions. Consequently, the petitioner filed an extension petition seeking additional time to surrender before the trial Court and furnish the sureties. However, the trial Court, by way of a docket order dated 07.10.2025, returned the extension petition on the ground that the time for surrender had already lapsed and, therefore, the petition was not maintainable. Therefore, he prayed to extend the time by setting aside the docket order of the trial Court. 4.

Upon considering the submissions made by the learned counsel for the petitioner and upon perusal of the material available on record, it is observed that the petitioner had filed an extension petition before the trial Court on 07.10.2025, seeking enlargement of time to surrender and furnish sureties as directed in the order dated 25.09.2025 passed in Crl.MP.No.258 of 2025. Considering the overall facts and circumstances of the case and taking into account the continuous public holidays that followed the date of the original order, which hindered compliance with the stipulated conditions, this Court finds it appropriate to set aside the

docket order of the trial Court and the petitioner is directed to furnish the sureties amount on or before 06.11.2025. 5.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
