HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE NO.802 OF 2015 ORDER:

This revision is filed by the petitioner-accused aggrieved by the order dated 30.4.2015 passed by the III Additional Judicial First Class Magistrate, Rajahmundry, East Godavari District, in Crl.M.P.No.1310 of 2015 in C.C.No.49 of 2015. The petitioner filed the above Crl.M.P. seeking to recall NBWs issued against him. The trial Court dismissed the said application on the ground that the petitioner is not co-operating for progress in the matter and he has been adopting delayed tactics in prolonging the matter and that the reasons mentioned by him for not attending the Court earlier are not satisfactory. Aggrieved by the same, the present revision case is filed.

Heard and perused the material available on record. The learned Counsel for the petitioner submitted that the petitioner undertakes to attend before the trial Court without fail on every date of hearing and therefore, the NBWs issued against the petitioner may be recalled. Having regard to the facts and circumstances of the case, the petitioner is directed to appear before the trial Court and file an application to recall NBWs on or before 23rd June, 2015. On such application being filed, the trial Court is directed to recall NBWs issued against the petitioner on the same day. Further, the petitioner is directed to appear before the trial Court regularly in future on every date of posting of the above C.C. till its disposal.

With the above direction, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
