This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri Nimma Narayana, Advocate for the Petitioners and the Public Prosecutor on behalf of the Respondent The Court made the following: ORDER

This is an application filed seeking the Court to extend time by one week for petitioner Nos.2 and 3 to surrender before the concerned Court. Learned counsel for the petitioners states that through orders in Crl.P.No.'10311 of 2022 dated 28.11.2022, this Court, while granting anticipatory bail, directed petitioner Nos.2 and 3 to surrender before the concerned Court within ten

(10) days but due to viral fever, petitioner Nos.2 and 3 could not surrendered and, therefore, time may be granted. Learned counsel for the petitioners submits that both the petitioners i.e. petitioner Nos.2 and 3 suffered with fever. The Medical Certificates produced reveal that both the petitioners took treatment at the same hospital during same time. However, those Medical Certificates go to show that they were advised to take rest till 09.12.2022 only. The request of extension of time was not made during that time or soon thereafter. However, considering the submission made, this Court considers it desirable to extend time, as prayed for. But pursuing the negligence on the part of petitioner Nos.

2 and 3 in obliging the directions though anticipatory bail was granted in their favour, this Court considers it desirable to extend time on payment of costs. Petitioner Nos.2 and 3 are directed to surrender before the concerned Court on or before 27 .12.2022 The Court concerned is directed to accept the surrender only on production of proof of payment of costs of Rs.10,0001 each to the Sainik Welfare Fund.
