Though, earlier the matter was directed to be listed under the caption 'for dismissal' and, accordingly, listed under the said caption on 01.09.2016, subsequently, learned counsel for the appellant, having taken time and got the present appeal removed from the said caption, again either not represented or made request for adjournment. Today also there is no representation for the appellant and there is no purpose in again listing the matter for dismissal.

Accordingly, the present appeal is dismissed for nonprosecution. There shall be no order as to costs.

3. As a sequel, miscellaneous applications, if any pending in the instant appeal, stand closed.
