Learned Counsel for the petitioner submits that the petitioner had given statement under Section 161 Cr.P.C, and notice was issued to him under Form - 96. Notice issued to the petitioner under Form - 96 reads as under:

"To Sri Banala Harish Rao, S/o. B.Srinivasa Rao, 29 years, Occ. Pvt. Employee, R/o.Plot No.202, B.N.Reddy Nagar, Vanasthalipuram, R.R. Dist.

Please take notice that your complaint under Section 380 IPC has been reported to the Class Magistrate of VIIth M.M.Court, Hayathnagar, Cyberabad (1)False (2) non-cognizable (3) mistake of fact or law (4) undertriable cases in which investigation are re used any stage come under this head (5) charge on M.F. on 10.08.2017 and that if you want to oppose this report you will have to do as before the above Magistrate within a week from the date of receipt of this notice. In as much as the complaint of the petitioner stands closed, no further orders are required to be passed in the Writ Petition.

The Writ Petition is, accordingly, closed.

Miscellaneous Petition, if any, shall stand closed. However, in the circumstances, without costs.
