THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13657 OF 2025 ORDER :

This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, by the petitioner/A.6 seeking regular bail in connection with Crime No.1877 of 2025 of Madhapur Police Station, Cyberabad. The offences alleged against the petitioner are under Sections 143, 144 of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS') and Sections 3, 4 and 5 of the Immoral Traffic (Prevention) Act, 1956.

The facts of the case are that on 01.10.2025, based on credible information, the Sub-Inspector, Madhapur Police Station conducted a raid at Hotel Saharsha Grand, Kothaguda X Roads, Kondapur, where alleged prostitution activities were reported. During the said raid, police claimed to have found six women suspected to be sex workers and one male customer in different rooms. The hotel receptionist, Goutham Patabandha (A.5), allegedly confessed to allocating rooms for such activities with the knowledge of the hotel owner who is the petitioner

- 2 - herein. Hence, complaint was lodged against the accused for the said offences.

Heard Sri B. Varaprasad Rao, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that basing on the confession statement of co-accused the petitioner herein is implicated. The victims who gave statements as Lws.7 to 12 clearly stated that they were engaged in prostitution at different places in Hyderabad under the directions of accused Sham and Roopesh. The victims just stayed in the hotel of petitioner and no such illegal activities were done in his hotel. He further submitted that none of the witnesses or victims have stated about any connection of the petitioner with A.1 to A.4. The petitioner is in jail form 02.10.2025. As such, prayed this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail on the ground that petitioner was running prostitution business by luring the victims from different states. The offences alleged against the petitioner are very serious in

- 3 - nature. As such, petitioner is not entitled to bail and prayed to dismiss this bail application.

Having regard to the submissions made and the material on record, the petitioner is in jail from 02.10.2025 and as seen from the record petitioner herein is shown as sub-organizer wherein he accommodated the alleged offence in his hotel. As informed to the Court, no other cases are pending against the petitioner. Considering the allegations against the petitioner and the period of incarceration of petitioner in jail, this Court deems it fit to grant bail to the petitioner subject to the following conditions :

i.

The petitioner/A.6 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of Xth-Additional Judicial First Class Magistrate, Ranga Reddy at Kukatpally.

ii.

The petitioner/A.6 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/A.6 shall abide by the conditions stipulated in Section 483(2) of BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
