THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.12498 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/accused No.10 in Crime No.280 of 2023, on the file of Hasanparthy Police Station, Warangal, registered for the offence punishable under Sections 20 (b) (ii) (B) and 27 r/w.8(c) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case against the petitioner is that he along with others was found transporting kg.157.520 gms of ganja and accordingly, they were seized.

Learned counsel for the petitioner submits that A-8 was granted regular bail who stands on the same footing as of the petitioner by the trial Court.

The marriage of the daughter of the petitioner is scheduled on 25.12.2023. In the said circumstances, this Court deems it appropriate to grant interim bail to the petitioner.

Accordingly, the petitioner shall be released on bail on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of Principal Junior Civil JudgeCum-Magistrate of First Class at Hanumakonda. The petitioner shall surrender on 02.01.2024.

After surrendering, the petitioner is at liberty to move the trial Court for grant of regular bail on the ground of parity. 7.

With the said observations, the Criminal Petition is disposed off. Miscellaneous applications, pending if any, shall stand closed.
