THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13664 OF 2025 ORDER :

This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, by the petitioner/A.9 seeking regular bail in connection with Crime No.1039 of 2025 of KPHB Police Station, Cyberabad. The offences alleged against the petitioner are under Sections 109, 308(2) r/w.3(5) and 49 of Bharatiya Nyaya Sanhita, 2023. 2.

The case of the prosecution is that the petitioner along with A.1 to A.8 attacked the defacto complainant and also stabbed him with knife, but as seen from the remand case diary the role of the petitioner herein is that he along with A.2 to A.8 beat the complainant with hands and he also helped CCL 1 for screening the evidence by keeping the knife in the reception which was used in the commission of offence. Hence, police registered a case against the accused for the above offences. 3.

Heard Sri S.Chandra Shekar, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for the respondent-State.

The contention of leaned counsel for the petitioner is that petitioner is in jail from 19.08.2025 and material part of investigation is already completed. A.1 in this crime was already granted bail by the trial Court and there are no specific allegations against this petitioner. Hence, prayed this Court to grant bail to the petitioner.

On the other hand learned Additional Public Prosecutor would submit that all the accused are involved in this case, there are serious allegations against this petitioner and that investigation is not yet completed. As such, prayed this Court to dismiss this petition.

Considering the submissions made by both counsel and the material on record, the petitioner is in jail from 19.08.2025 and as seen from the record Lws.1 to 14 are examined including the investigating officer. Considering the period of incarceration of petitioner in jail and the progress in investigation, this Court deems it fit to grant bail to the petitioner subject to the following conditions :

i.

The petitioner/A.9 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of IV AJCJ-cum-XV Additional Metropolitan Magistrate at Kukatpally, Cyberabad.

The petitioner/A.9 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/A.9 shall abide by the other conditions stipulated in Section 483(2) of BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
