THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER WRIT APPEAL No.1762 of 2013 JUDGMENT: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) Sri Kambham Madhava Reddy, learned counsel for the respondent, would submit that, in the light of the interim order passed by this Court on 04.12.2013, the amount, as directed to be paid by the learned Single Judge, was paid by the appellants. It is evident, therefore, the cause in the writ appeal does not survive necessitating any further adjudication by this Court. The only question which remains to be considered is imposition of costs of Rs.10,000/- by the learned Single Judge. While there appears to be an abnormal delay in payment of the amount due to the respondent-writ petitioner, considering the explanation given thereto by the Corporation, we deem it appropriate to reduce the costs, imposed by the learned Single Judge, from Rs.10,000/- to Rs.5,000/-.
The writ appeal is, accordingly, disposed of. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
