HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.30188 of 2018 ORDER:
1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the 3rd respondent in trying to demolish the petitioner's residential building vide D.No.3-100, situated in Sy.No.212/ 1 of Thammayyapeta Village, Dopperla Gram Panchayat, Atchuthapuram Mandal, Visakhapatnam District, without issuing any notice and without following the due process of law is illegal, arbitrary and violative of principles of natural justice.
2) Learned counsel for the petitioner would submit that the respondents are illegally trying to demolish the building, which was constructed in his own land situated in Sy.No.212/ 1 of Thammayyapeta Village. The same is disputed by the learned Government Pleader for Revenue (AP), stating that the land where the building was constructed is a Government Land ie. Gadda Poramboke and also submits that no permission was obtained to construct the said house.
3) Having regard to the above, the Writ Petition is disposed of, giving liberty to the respondents to take steps for demolishing the structures, if it is in violation of law. But, any action to be taken, the same shall be in accordance with law.
4) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
