THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.12504 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/accused No.4 in Crime No.1057 of 2023, on the file of Chaitanyapuri Police Station, Ranga Reddy District, registered for the offences punishable under Sections 307, 452, 504 and 506 r/w. 34 of IPC. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that on 01.12.2023, this petitioner who is arrayed as A-4 and 5 others who are named in the remand report have attacked the victim with knives and rods. In the said altercation, it is alleged that three persons were injured.

On instructions, learned Additional Public Prosecutor would submit that injured have been treated in the hospital.

Learned counsel appearing for the petitioner would submit that there is no specific overt act attributed to this petitioner. In fact, the petitioner is working in a private institution and he has nothing to do with the alleged assault. 6.

Keeping in view that an omnibus allegation is made against the petitioner that he was involved in attack of the victim, this Court deems it appropriate to grant the relief regular bail, subject to following conditions: i) The petitioner/accused No.4 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of IV Additional Metropolitan Magistrate Court, R.R.District.

ii) The petitioner/accused No.4 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of eight weeks and thereafter, as and when required for the purpose of investigation.

iii) The petitioner/accused No.4 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
