HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 6871 of 2009 Order:

This Writ Petition was filed challenging the proceedings No.534/2008-C1, dated 22.03.2009, issued by the second respondent in respect of the petitioner's IL and FL licenses, situated at Yadagirigutta village and mandal, Nalgonda District, as illegal, arbitrary and contrary to the provisions of the AP Excise Act, 1968.

2. This Court, while admitting the Writ Petition, by an order dated 01.04.2009, granted interim stay and the said order is in operation.

3. When the Writ Petition is taken up for hearing, learned counsel for the petitioner submits that this Writ Petition is a part of batch of cases in WP No.6662 of 2009 and batch, but this Court noticed that those batch of cases were disposed of on 15.04.2009.

4. Be that as it may, the impugned order, dated 22.03.2009, was issued directing the petitioner to show cause as to why the license should not be suspended for violation of the rules and license conditions.

The petitioner also submitted his explanation on 30.03.2009.

5. In view of the submission of explanation by the petitioner, pursuant to the show cause notice, dated 22.03.2009, this Court is not inclined to interfere with the enquiry process and it is open to the second respondent to consider the explanation submitted by the petitioner and pass appropriate orders in accordance with law.

6. The Writ Petition is, accordingly, disposed of. However, in the circumstances, no costs.

7. As a sequel thereto, the miscellaneous petitions, if any, pending

in this Writ Petition shall stand closed.
