HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.24179 of 2017 ORDER:
The prayer in the writ petition reads as follows: "To issue a writ, order or direction, more particularly one in the nature of writ of mandamus declaring that the action of the respondents in not considering the petitioner tender on the ground that he has not paid the EMD amount at the rate of Rs.85,000/- but paid Rs.15,000/- is bad, arbitrary, illegal, unjust, unreasonable and contrary to the main tender notice dt.16-06-2017 and consequently direct the respondents to entertain/consider the petitioner tender to the Sl.No.41 cycle stand-1, Stall No.31 (30x60) in Choutuppal Bus Stand for lease in pursuance of the E-Tender Notice No.02/122(29)/2017-RM.NLG dt.16-06-2017 and pass such other order or orders."
Heard the learned counsel for the petitioner and also Sri A.Ravi Babu, learned standing counsel for respondent Nos.1 to 3 and before ordering notice to the unofficial 4th respondent and perused the prayer in the writ petition with the supporting affidavit and other material on record.
As per the supporting affidavit, it is the submission supported by the material on record that the original tender notification speaks about only Rs.15,000/- and whereas the modified order not within the knowledge of the petitioner is on 28.06.2017 for Rs.85,000/- and there is no deliberate nonpayment, but for inadvertence if at all besides mainly from lack of knowledge and therefrom he is the highest bidder can be permitted to pay.
Dr. SSRB,J Having regard to the above and in the result, the Writ Petition itself is disposed of by extending time to pay said differential amount on or before 24.07.2017, if at all paid with further payment of Rs.5,000/- to compensate the delay. Consequently, miscellaneous petitions, if any shall stand closed. No costs.
