HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.30348 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 4th respondent-Sub Registrar, in not releasing the sale deed (Document No.224/2018), dated 5.6.2018, presented by the petitioner in respect of the agricultural land admeasuring Ac.19.00 gts (out of Ac.21.12 gts) situated at Sy.No.392 (Part) of Parkibanda Village, the then Shivampet Mandal within the limits of Manoharabad Mandal, Medak District, despite no notification under Section 22(A) of the Registration Act, 1860 (for short, "the Act"), being issued prohibiting the registration in respect of the subject land, as illegal and arbitrary. Learned counsel for the petitioner submits that though the petitioner submitted the sale deed for registration of the subject land on 5.6.

2018 in the office of the 4th respondent-Sub Registrar, by complying with all the requirements, no action has been taken by the 4th respondent so far. He further submits that no notification was also issued prohibiting the registration of the subject land. Learned Government Pleader for Revenue would submit that a direction may be given to the 4th respondent to pass appropriate orders on the document submitted by the petitioner.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 4th respondent-Sub Registrar, to process the sale deed (Document No.224/2018) dated 5.6.2018, presented by the petitioner in respect of the agricultural land admeasuring Ac.19.00 gts (out of Ac.21.12 gts) situated at Sy.No.392 (Part) of Parkibanda Village, the then Shivampet Mandal within the limits of Manoharabad Mandal, Medak District, if the same is in accordance with the provisions of the Indian Stamps Act and Registration Act and release the same forthwith. However, if the 4th respondent is not satisfied

with the document presented by the petitioner for registration, the 4th respondent, shall return the same assigning valid reasons, as early as possible, preferably within a period of two to four weeks from today, by giving reasonable opportunity of hearing to the petitioners and all the concerned.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
