THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.12500 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.2, 4, 5, 7 to 10 seeking bail in the event of their arrest in connection with Crime No.683 of 2023 on the file of Mahbubnagar Rural Police Station, Mahbubnagar, registered for the offences under Sections 458, 448, 323, 427, 504, 506 and 379 r/w. 34 of IPC.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The complaint was lodged with the Mahbubnagar Rural Police Station stating that A-1 who is the brother of local MLA along with these petitioners has trespassed into the house of de-facto complainant and damaged the property and threatened to kill her. The CC TV footage was also damaged. 4.

Learned counsel appearing for the petitioners would submit that due to political rivalry a false complaint is filed against these petitioners.

However, keeping in view that there are no details of property which was subjected to theft in the complaint and since it appears that there are political differences, this Court is inclined to grant the relief of anticipatory bail, subject to following conditions:-

1) The petitioners/Accused Nos. 2, 4, 5, 7 to 10 are directed to surrender before the Station House Officer, Mahbubnagar Rural Police Station, Mahbubnagar, on or before 29.12.2023. Upon such surrender, the said Station House Officer shall release the petitioners/Accused Nos. 2, 4, 5, 7 to 10 on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum each to his satisfaction.

2) On such release, the petitioners/Accused Nos. 2, 4, 5, 7 to 10 shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of eight weeks for the purpose of investigation and thereafter, as and when required.

3) The petitioners/Accused Nos. 2, 4, 5, 7 to 10 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
