THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.8703 of 2016 ORDER:

Heard Sri S.M.Subhani, learned counsel for the petitioner, and Sri Sd.Naimullah, learned Standing Counsel for the Wakf Board.

The prayer of the petitioner in this case is as under: "This Hon'ble Court may be pleased to issue a Writ order or direction more particularly one in the nature of Writ or Mandamus, declaring action of the 2nd respondent for not constituting the Building Constructions-cum-Managing Committee to a notified Wakf known as Mohammedia Wakf Complex, Risaldar Mosque, Kurnool Town inspite of receipt of petitioner's representation dated 07.09.2015 and 4.2.2016 is being illegal, arbitrary, unconstitutional and the provisions of Wakf Act 1995 and the rules made there under and pass such other order or orders as this Hon'ble court may deem fit and proper in the circumstances of the case."

As the petitioner's representations dated 07.09.2015 and 04.02.2016 submitted to the Wakf Board in relation to the aforestated prayer are pending consideration, this Court sees no purpose served in entertaining this writ petition for adjudication on merits at this stage. It is for the Wakf Board to consider the aforestated representations and take appropriate action thereon in accordance with law.

The writ petition is therefore disposed of directing the second respondent-Wakf Board to consider the petitioner's representations dated 07.09.2015 and 04.02.2016 in accordance with law and take appropriate action thereon. This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall stand closed
