HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.6383 of 2015 ORDER:

Heard.

The petitioner states that he is the owner of the vehicle bearing No.AP-31-B-V-7107. The petitioner also states that the said vehicle was seized in respect of registration of Cr.No.74 of 2014 for the offence punishable under Section 34(a) of the A.P. Excise Act. The petitioner approached the 2nd respondent seeking interim custody of the said vehicle. Since no orders are passed by the 2nd respondent, the petitioner filed the present writ petition.

On instructions, learned Government Pleader states that no such application is stated to have been filed by the petitioner before 2nd respondent.

Since the application of the petitioner made before the 2nd respondent is not on record nor the petitioner has filed copy of that application, the writ petition is disposed of with the following directions:- "If any application of the petitioner for interim release of the vehicle is pending before the 2nd respondent, he shall consider the same and pass appropriate orders within one week from the date of receipt of a copy of this order. The petitioner is also at liberty to make fresh application to enable the 2nd respondent to consider the same and pass appropriate orders as stated above." No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
