THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.38629 of 2015 ORDER:

Heard Sri Sai Gangadhar Chamarty, learned counsel for petitioner, learned Government Pleader for Civil Supplies for respondent Nos.1 to 3 and 5 and Sri A.Jagan, learned Standing Counsel for 4th respondent.

2. The petitioner is the proprietrix of a rice mill by name Dhanalaxmi Traders. An agreement was entered into by 4th respondent with the petitioner for storage and custom and milling of paddy into raw/boiled rice, which is valid for Rabi 201415 and Khariff 2015-16 or till the completion of CMR deliveries for the paddy delivered to the mill. The 2nd respondent issued a letter dt.03-10-2015 stating that the Government of India had extended the time for completion of milling and delivery of C.M.R. into Central Pool for K.M.S. 2014-15 upto 30-11-2015 in respect of Telangana State and also stating that no extension would be provided after 30-11-2015.

The petitioner submitted a representation to the 3rd respondent with a copy to respondent Nos.4 and 5 explaining that the proprietor of petitioner firm was out of country to attend her daughter, who is pregnant and sought permission to supply raw rice instead of boiled rice by extending time for a period of one

month. The petitioner contends that the said representation has not been disposed of by 3rd respondent.

4. Learned Government Pleader for 3rd respondent states that 3rd respondent will respond to the petitioner's representation within a period of two weeks from the date of receipt of a copy of this order.

5. In this view of the matter, the Writ Petition is disposed of directing the 3rd respondent to dispose of the representation dt.19-11-2015 pending with 3rd respondent within two weeks from the date of receipt of a cop of this order and communicate the decision thereon to petitioner. No costs.

6. As a sequel, miscellaneous petitions pending if any, in these Revisions shall stand disposed of.
