HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.30327 OF 2018 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Mines and Geology, appearing for the respondents. The limited grievance of the petitioner, in the present writ petition, is the alleged inaction on the part of the respondent - authorities in processing the application of the petitioner, dated 23.12.2016, submitted for grant of quarry lease for quartzite and gravel in an extent of 5.00 hectors i.e., Ac.12.355 cents in Survey No.330 of Bheemsingi Village, Jami Mandal, Vizianagaram District.

After receipt of the application of the petitioner and after the same was forwarded by the Assistant Director of Mines and Geology, Vizianagaram, the Tahsildar, Jami, vide proceedings in Rc.No.238/A/2017, dated 29.05.2017, expressed no objection for grant of quarry lease over an extent of Ac.10.15 cents in Survey No.330 of Bheemsingi Village.

Further grievance, according to the learned counsel for the petitioner, is that despite receipt of the no objection certificate from the Tahsildar, as long back as on 29.05.2017, no action has been taken so far by the respondent - authorities in the direction of granting lease to the petitioner herein.

Having heard the learned counsel for the petitioner and the learned Government Pleader for Mines and Geology, this Court deems it appropriate to dispose of the writ petition with a direction to the respondents to take further action pursuant to the no objection certificate issued by the Tahsildar, Jami, vide Rc.No.238/A/2017, dated 29.05.2017,

and pass appropriate final orders, strictly in accordance with law, within a AVSS,J W.P. No.30327/2018 period of four (4) weeks from the date of receipt of a copy of this order. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending, shall also stand disposed of in consequence.
