THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.26442 of 2017 ORDER:
Heard learned counsel for the petitioners and the learned Government Pleader for Prohibition & Excise(A.P.). The grievance of the petitioners in this Writ Petition is the alleged inaction on the part of the respondents in granting 2B licences to the petitioners despite submitting representation dated 14.07.2017.
According to the learned counsel for the petitioners the premises intended for the proposed shops are located within the Nellore Municipal Corporation area. It is submitted that the inaction on the part of the respondents is also contra to the orders of the Honourable Apex Court. Learned counsel has placed on record the order passed by the Honourable Apex Court in S.L.P.No.10243 of 2017 dated 11.07.2017. In the said order the Honourable Apex Court issued a clarification stating that the orders passed earlier do not prohibit licensed establishments within the municipal areas.
In view of the above, the petitioners herein are permitted to submit representations to the licensing authority, by enclosing a copy of the of order of the Honourable Apex Court referred to supra, within a period of one week from the date of receipt of a
copy of this order and, if any such representation is submitted, the same may be considered and appropriate orders be passed in accordance with law within a period of three weeks thereafter. The Writ Petition is, accordingly, disposed of. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
